Terms of Service

Last updated: 13 September 2026. These terms are between the customer and Resource Innovative Technologies LLC, Rock Hill, SC.

1. Agreement

These terms govern access to AtsIcloud. By installing the application or creating an account, the customer accepts them on behalf of the organisation they represent.

2. Subscriptions and billing

Subscriptions are billed per user seat, monthly or annually in advance. Seats may be added at any time and are charged pro rata; reductions take effect at the next renewal.

3. Acceptable use

• Do not upload personal data you have no lawful basis to process.
• Do not attempt to access another customer’s workspace.
• Do not use the application to unlawfully discriminate against candidates.
• Do not use connected mailboxes to send unsolicited bulk mail in breach of applicable law.

4. Customer data

The customer retains all rights in the data they upload or generate. We process it only to provide the application. Export is available at any time during the subscription.

5. AI features

AI features operate on the customer’s own provider keys unless a managed option is agreed in writing. Output is generated automatically, is queued for human review, and is not a substitute for the customer’s own hiring judgement or legal compliance.

6. Availability

The desktop application operates on local data and remains usable offline. For cloud synchronisation we target 99.9% monthly availability excluding scheduled maintenance. Firm-tier agreements may carry a separate service level.

7. Liability

To the extent permitted by law, neither party is liable for indirect or consequential loss. Our aggregate liability is limited to the fees paid in the twelve months preceding the claim.

8. Termination

Either party may terminate at the end of a billing term. On termination the customer may export their data, after which it is deleted in line with the Privacy Policy.
